It binds the developer, the Pine Hollow Homeowners Association, and all lot owners to maintain stormwater infrastructure. - Stormwater maintenance responsibility: The developer (Declarant) is responsible for constructing and maintaining stormwater control facilities until ownership is transferred to the HOA or a commercial lot owner. After transfer, the Responsible Party must maintain them per the approved Stormwater Operations and Maintenance Manual and Budget.
- Mandatory HOA membership & assessments: If the HOA is the Responsible Party, membership is mandatory for every lot served by the stormwater facilities, and the HOA can levy assessments for maintenance costs. Unpaid assessments become a lien on the lot.
- City enforcement & penalties: Failure to maintain stormwater facilities can result in daily civil penalties and other enforcement by the City of Raleigh. The City may also perform maintenance itself and charge the lot owners, with unpaid charges becoming liens.
- Easements granted to the City: The City has permanent, non-exclusive easements to inspect and maintain stormwater facilities, including access across private roads and easements. The City is not obligated to maintain them and is not liable for their condition.
- Insurance requirement: The Responsible Party must maintain liability insurance of at least $1,000,000 for the stormwater control facilities.
