Trailwood Hills is a single-family home HOA in Raleigh, NC, governed by a Declaration of Protective Covenants. This document binds all lot owners to the HOA's rules and assessments, covering property use, architectural control, and maintenance responsibilities.
- What you own & maintain: You own your lot and the detached single-family home on it, and you're responsible for maintaining the exterior and lot. The HOA maintains the common areas (greenways, private streets, amenities) and can step in to fix neglected properties, charging you the cost plus a 15% service fee.
- Architectural review: Before any construction, alteration, fence, or even window displays, you must submit plans and get written approval from the HOA or an architectural committee. If they don't respond within 30 days, approval is deemed given. A review fee up to $25 may apply.
- Parking & vehicles: No trucks, RVs, boats, trailers, or commercial vehicles may be parked overnight on your lot unless hidden in a garage or otherwise concealed. Boats and trailers are also banned from public street rights-of-way. The HOA can further regulate or prohibit such parking.
- Pets & animals: You may keep dogs, cats, or other household pets, but not for commercial purposes. Livestock, poultry, and other animals are not allowed.
- Use of property: Lots are for residential use only, with one family per lot as principal residence. No outdoor clotheslines, no signs (except political yard signs and temporary 'For Sale' signs), and no noxious or offensive activities. Trash must be stored in sightly containers.
- Assessments & fees: The HOA levies annual and special assessments, which are a lien on your property if unpaid. The maximum annual assessment was $50 per lot through June 1995, then can rise annually by CPI (capped at 12% per year) without a vote, or higher with a 2/3 member vote. Special assessments for capital improvements require a 2/3 vote. Delinquent assessments accrue 12% interest and collection costs.
- Voting & membership: Each lot gets one vote in the HOA, but if the owner doesn't live there or the lot is rented, that vote is capped at 49% weight on most matters. The developer holds Class B voting rights until 75% of lots are sold or June 1, 2004.
