What Trailwood (NC)'s governing documents say
This is a set of covenants for Trailwood, a single-family home subdivision in Nash County, NC, plus a separate declaration for Trailwood Heights Condominium in Raleigh, NC. The first document restricts how you can use and build on your lot; the second governs a condo association where you own a unit and share common areas. If you're a homeowner or buyer in either community, these rules will affect your daily life and property choices.
- What you own & maintain: In the single-family section, you own your lot and must maintain it, including drainage easements. In the condo, you own your unit's interior and are responsible for repairs inside; the association maintains common elements and limited common elements like balconies and entrance doors.
- Building & design restrictions: For Trailwood single-family: only one detached single-family home per lot, max 3 stories, with minimum heated floor areas (1400 sq ft for one-story, 850 sq ft for multi-story, total 1700 sq ft). Setbacks and side-yard rules apply, and any building or exterior change needs architectural committee approval.
- Use restrictions: Both communities restrict use to residential purposes only. No noxious activities, temporary structures as residences, or commercial animal breeding. In the condo, no 'for sale' or 'for rent' signs without board approval, and no transient rentals (less than 30 days).
- Leasing & rentals: In the condo, you may lease your unit, but leases must be in writing, for the entire unit, and for at least 30 days. You must notify the association of the lease terms, and subleasing requires board consent. The single-family covenants don't address leasing.
- Pets: In the single-family section, you can keep dogs, cats, or other household pets as long as they're not for commercial purposes. In the condo, no more than two dogs, two cats, or two other household pets are allowed, and the board can ban any pet it deems a nuisance.
- Assessments & fees: The condo association can levy assessments for common expenses, and unpaid assessments become a lien on your unit. The developer can require an initial payment up to two months' assessments. The single-family covenants don't mention HOA fees.
- Insurance: The condo association must carry casualty insurance on the property and liability insurance of at least $1,000,000 per occurrence. Unit owners can buy their own policies for personal property and liability. The single-family covenants don't address insurance.
- What this document doesn't cover: This excerpt doesn't include the full condo bylaws, rules and regulations, or the complete list of assessments and fees. It also doesn't cover any HOA for the single-family section, as none is mentioned. For current rules, contact the respective association.
