This is a first amendment to the Declaration of Covenants, Conditions and Restrictions for Victoria Park Townhome Community, a townhome HOA in Raleigh, NC. It shifts responsibility for exterior maintenance and repairs from the HOA to individual lot owners, while the HOA retains responsibility for lawn care and common areas. This document is for current and prospective homeowners in this community.
- What you own & maintain: As of November 1, 2016, each lot owner is solely responsible for the cost of maintaining and repairing their home's exterior, including roofs, windows, gutters, downspouts, patios, exterior walls, doors, walks, driveways, painting, staining, and tree removal on their lot. The HOA is no longer responsible for these costs.
- HOA responsibilities: The HOA remains responsible for lawn maintenance of each lot, maintenance of fencing along the neighborhood border, mailboxes, brick entrance walls along Edward Mills Road, designated common areas, and (unless maintained by the City of Raleigh) street lights and fire hydrants.
- Architectural review: This amendment does not change the requirement for HOA approval before replacing or changing shrubbery on a lot. Front shrubbery replacement is the homeowner's responsibility with HOA approval; back yards are at the homeowner's discretion.
- Assessments: The HOA still has the right to levy assessments under the Declaration, but these will no longer be categorized as 'Exterior Maintenance' assessments. They may be part of general dues and assessments as established in the By-Laws and Article V of the Declaration.
- What this document doesn't cover: This is only an amendment to the original Declaration, so it does not cover the full set of HOA rules, restrictions, or fees. It does not address pet rules, leasing, parking, or other typical HOA covenants.
