Spring Branch Corners is a small commercial condominium development in Smithfield, NC, governed by a declaration of covenants, conditions, and restrictions. This document applies to property owners (and certain leaseholders) of the commercial units, not to residential homeowners. It establishes rules for building design, use, and maintenance of the commercial property.
- Property type & ownership: This is a commercial condominium community; owners hold fee simple title to their units and share common areas. Leaseholders are considered owners only if their lease explicitly says so.
- Architectural review: All new buildings, exterior changes, and improvements (including fences, landscaping, and signs) require written approval from a 3-member architectural committee. Approval is deemed given if the committee doesn't respond within 30 days.
- Use restrictions: Property may only be used for commercial purposes. No animals, livestock, or poultry are allowed. Mobile homes, tents, and temporary structures are prohibited, and no antenna or satellite dish may be installed without permission.
- Building height & setbacks: Buildings cannot exceed two stories (excluding foundation/basement) unless approved by the architectural committee. Setbacks must comply with Smithfield zoning.
