The declaration governs specific lots and binds all owners to rules about construction, maintenance, and assessments. The HOA (Everett's Creek Lots HOA, Inc.) manages stormwater facilities, non-state maintained streets, and enforces the covenants.
- Residential use & construction: Lots are limited to single-family residential use. Only site-built homes are allowed; no mobile, modular, or manufactured homes. Minimum heated living area is 1,000 sq ft for one-story or 750 sq ft ground floor for two-story. Construction must be completed within 12 months.
- Architectural review: All exterior improvements (buildings, fences, driveways, landscaping) require prior written approval from the Architectural Control Committee (ARC) to ensure harmony of design. - Pets & animals: Only dogs, cats, or other household pets are allowed, not for commercial purposes. They must be kept within an enclosed fence or leashed and under control at all times. No livestock or poultry.
- Fences & setbacks: Fences over 6 ft high are prohibited. No fences are allowed between the front of the house and the street, except decorative fences up to 1 ft. Setbacks: minimum 8 ft from side/rear property lines (10% variance allowed). Front and side street setbacks per recorded plat.
- Stormwater & environmental restrictions: Each lot has a maximum built-upon area (e.g., 2,000–3,000 sq ft per lot). No filling or piping of vegetative conveyances. Lots adjacent to surface waters must maintain a 50 ft vegetated buffer. Wetlands must be preserved in natural condition; no grading, vegetation removal, or construction.
