What Nc Clean Water's governing documents say
This is a conservation easement and restrictive covenant document for the NC Clean Water project in Sneads Ferry, NC. It binds the landowner (a municipality or conservancy) to preserve the property in its natural state for water quality and wildlife protection. It is not a homeowner association or rental community rulebook; it applies to the land itself, not to residents.
- Conservation purpose: The property must be maintained in its natural, scenic, wooded, and open condition to protect surface waters and wildlife. Any use that impairs these conservation purposes is prohibited.
- Prohibited uses: Industrial, commercial, agricultural, timber harvesting, grazing, and horticultural operations are banned. No filling, excavation, dredging, mining, or removal of topsoil, sand, gravel, or minerals is allowed. Dumping of trash, waste, or abandoned vehicles is also prohibited.
- Allowed uses: Passive recreation (e.g., nature trails, picnic shelter up to 2,000 sq ft on one acre), selective cutting for trail maintenance, prescribed burning with Fund approval, hunting/fishing per regulations, and utility easements for adjacent property are permitted.
- Duration & termination: The covenants run with the land until January 1, 2095, with automatic five-year extensions. They may be terminated earlier by recording a termination instrument signed by both Grantor and State, or by recording a conservation easement covering the property.
- Enforcement & remedies: The State (or its assignee) may enforce the covenants, require restoration of damaged areas, and seek legal remedies including injunctions and damages. The Grantor has 90 days to cure a breach after written notice.
- Transfer & subdivision: The property may not be subdivided, partitioned, or conveyed except as a single block. Any transferee must be a qualified conservation organization and must assume the covenants. The Grantor must notify the State of any transfer.
- What this document doesn't cover: This document does not govern residential occupancy, leasing, pets, parking, architectural changes, or any typical HOA or condo rules. It is a land conservation restriction, not a community association rulebook.
