What Cape Fear's governing documents say
This is a Declaration of Restrictive Covenants for Bradham Place, a single-family home subdivision in Richlands Township, Onslow County, NC. It applies to Lots 20–41 and sets rules for residential use, construction, pets, and stormwater management. There is no homeowners association; enforcement is by any property owner.
- Land use & structures: Each lot is for residential use only, with one single-family dwelling plus garages and outbuildings. Temporary structures, tents, and campers cannot be used as residences.
- Construction standards: Allowed homes include conventionally built, modular, or permanently affixed double-wide manufactured homes with underpinning or skirting. Single-wide mobile homes are prohibited.
- Pets & livestock: Dogs, cats, and traditional household pets are allowed on a leash or within a fenced area, not for commercial purposes. On lots of one acre or more, one horse per acre is permitted. No other livestock or poultry may be raised, bred, or kept.
- Nuisances & vehicles: No noxious or offensive activity is allowed. Inoperable or abandoned vehicles may not remain on any lot.
- Stormwater management restrictions: Each lot has a maximum built-upon area (BUA) listed in Exhibit A (e.g., 6,530 or 8,710 sq ft). A 30-foot vegetated buffer must be maintained between impervious areas and surface waters. Roof drains must terminate at least 30 feet from the mean high water mark. Drainage alterations require state approval.
- Term & enforcement: These covenants run with the land for 35 years from the recording date (2008). They may be enforced by any person with an interest in the property through legal proceedings. The declarant may annex adjoining property without owner consent.
- What this document doesn't cover: This document does not create a homeowners association, set fees or assessments, regulate leasing, or establish architectural review procedures. It is a set of restrictive covenants only.
