The Cliffs at Windpointe is a single-family home subdivision in Sneads Ferry, NC, part of the larger Windpointe master-planned community. This Master Declaration of Covenants, Conditions and Restrictions (CC&Rs) establishes the Windpointe Homeowner's Association and sets rules for all lots in the subdivision. It applies to homeowners, tenants, and residents, and covers assessments, use restrictions, architectural control, and maintenance obligations.
- What you own & maintain: You own your lot and dwelling unit. You must maintain your yard (grass no taller than 6 inches) and exterior of your home. The Association maintains common areas, including private roads, landscaping, and recreational facilities.
- Assessments & fees: Annual assessments start at $325 and can increase up to 5% per year without a membership vote; increases over 5% require a 2/3 vote. Special assessments for capital improvements over $2,500 per item require a 2/3 vote. A working capital fee of 1/6 of the annual assessment is due at closing. Late charges are the greater of $20 or 20% of the delinquent amount, with 10% annual interest.
- Architectural review: No exterior changes (including paint, fences, windows, or additions) may be made without prior written approval from the Board or an architectural control committee. Approval may be denied based on harmony of design, color, or aesthetics.
- Parking & vehicles: No parking of trailers, RVs, boats, or trucks over 1 ton unless inside a closed garage. Operative vehicles limited to 4 per lot. Inoperative vehicles must be garaged with door closed. No auto repairs outside garage. Violators may be towed at owner's risk.
- Use restrictions: Lots are for residential use only; no businesses, trades, or professions allowed. Home offices are permitted if they don't increase traffic or disturb neighbors. Common areas may not be obstructed with personal items.
- Leasing & rentals: The document does not specify minimum lease terms or rental restrictions beyond requiring tenants to comply with rules. Tenants have a non-transferable right to use common areas.
- Insurance: The Association carries master property and liability insurance on common areas. Owners must insure their own dwelling unit and contents, and carry liability insurance. Owners are responsible for the insurance deductible if they cause damage to common areas.
