The Preserve at Fisher Landing is a planned community in Southport, NC, governed by a homeowners' association (HOA). This document is the full Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that applies to all lot owners. It covers property rights, assessments, use restrictions, architectural control, and stormwater management.
- What you own & maintain: You own your lot and the dwelling on it. The association maintains common elements (private roads, open space, stormwater ponds) and the exterior of townhome buildings (but not unit interiors). Owners must maintain their lots, including landscaping and structures, and must obtain architectural approval for exterior changes.
- Leasing & rentals: Short-term rentals of six months or less (including VRBO/Airbnb) are prohibited. Leases must be for at least six months.
- Pets: No more than two dogs, cats, or other household pets per lot. Certain breeds (American Pit Bull Terrier, American Staffordshire Terrier, American Bully, Staffordshire Bull Terrier) are prohibited. Pets must be leashed and not become a nuisance.
- Vehicles & parking: Boats, campers, trailers, commercial vehicles, and inoperable vehicles are not allowed on lots or common elements without written consent. Vehicles must have current registration and insurance.
- Architectural review: All exterior changes (structures, painting, landscaping in front yards, replacement doors/windows/garage doors) require prior written approval from the Architectural Control Committee. The committee has 30 days to respond; failure to act means approval is deemed given.
- Assessments & fees: Annual assessments fund common area maintenance, insurance, and operations. Special assessments may be levied for capital improvements (requires 2/3 vote) or to reimburse the developer. Individual assessments (fines) may be imposed for violations. Assessments become a lien on the lot if unpaid for 30+ days.
- Stormwater & environmental rules: Each lot has a maximum built-upon area (BUA) of 4,500 square feet. A 50-foot vegetative setback must be maintained adjacent to surface waters. The association must comply with the state stormwater permit.
- Signs & flags: No exterior flag poles are allowed. Other flags require architectural approval. During the developer control period, only developer signs are allowed; after that, owners may place one 'for sale' sign on their lot.
