Smithville Townes is a townhome community in Southport, NC, governed by a homeowners' association (HOA). The HOA maintains common areas and exterior elements of the homes, funded by assessments on all lot owners. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that bind all owners and residents.
- What you own & maintain: You own your lot and dwelling. The HOA maintains common areas, exterior building surfaces (repainting, roof replacement, gutters), and landscaping installed by the developer. You are responsible for interior maintenance, windows, exterior doors, fences, landscaping inside fences, HVAC, and any damage caused by you or your guests.
- Leasing & rentals: There are no restrictions on lease duration or frequency. All leases must require tenants to comply with the CC&Rs and HOA rules.
- Pets: A reasonable number of cats, dogs, or other household pets are allowed for companionship only. They must be leashed and not become a nuisance. The HOA can require removal of nuisance animals.
- Parking & vehicles: No street parking except in designated paved spaces. No abandoned, inoperative, or unregistered vehicles. No boats, trailers, RVs, campers, buses, trucks over one ton, or commercial vehicles on lots or streets. The HOA may tow violators at the owner's expense.
- Signs & flags: Political signs are allowed without prior approval if no larger than 24x24 inches, displayed no earlier than 45 days before an election and removed within 7 days after, and placed only on your own lot. One U.S. flag and one North Carolina flag are allowed without approval (max 4x6 feet, on a wall-mounted pole up to 6 feet or a freestanding pole up to 16 feet). Real estate signs up to 6 square feet are allowed without approval during sale or lease. All other signs require HOA approval.
- Architectural review: Any improvements, changes, or modifications to your lot or dwelling require prior approval from the HOA (or Declarant during the Declarant Control Period) under architectural guidelines the HOA may adopt.
- Assessments & fees: Regular assessments are set annually and can increase up to 10% per year. A working capital fee of one-sixth of the annual assessment is due at initial purchase. Special assessments may be levied for capital improvements or extraordinary expenses. Late payments incur interest, collection costs, and a lien on your lot.
- Declarant control period: The developer (Declarant) controls the HOA board until the earliest of: December 31, 2030; when Declarant's votes equal those of other owners; or relinquishment of special declarant rights. During this period, Declarant can appoint and remove directors and amend the declaration unilaterally for certain purposes.
