Beckington Townhomes is a planned community of townhomes in Sunset Beach, NC, governed by a homeowners association (HOA). This document is the full Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that applies to all lot owners. It covers assessments, architectural controls, use restrictions, and maintenance responsibilities.
- What you own & maintain: You own your lot and the dwelling on it. You must maintain your unit and lot in good repair, including lawns, trees, and exterior surfaces. The association maintains common areas (e.g., private streets, stormwater facilities, open space) and carries master insurance on common areas.
- Assessments & fees: Each owner pays annual assessments to fund common expenses. A working capital fee equal to one quarter of the annual assessment is due at closing. Special assessments for capital improvements require a 2/3 vote of owners unless the board declares an emergency. Unpaid assessments become a lien on the lot.
- Architectural review: All exterior changes (buildings, fences, mailboxes, signs, landscaping) require prior written approval from the Architectural Review Board. - Use restrictions & nuisances: Units may only be used as single-family residences. No short-term rentals, time shares, hotels, or bed-and-breakfasts. Home occupations are allowed only if they don't impact common facilities or create noise, odors, or traffic. No family day care businesses.
- Pets: Household pets (dogs, cats) are allowed but not for commercial breeding. No livestock, poultry, venomous animals, or reptiles. Pets must be registered, licensed, and inoculated, and owners must clean up waste immediately.
- Parking & vehicles: No commercial vehicles, large trucks (over 24 ft), recreational vehicles, or inoperable vehicles may be parked on lots unless concealed in a garage. Temporary parking for service vehicles is allowed. No vehicle repairs visible from outside a garage.
- Leasing & rentals: Leases must be for at least six months; short-term rentals are prohibited. Owners must notify the association before renting. Tenants must comply with all rules.
- Stormwater & environmental restrictions: Each lot has a maximum built-upon area limit (see Exhibit C). A 50-foot vegetated buffer must be maintained between impervious surfaces and surface waters. Drainage alterations require state approval.
