Seaside Palms is a new single-family home HOA in Sunset Beach, NC. The developer (Declarant) controls the association until at least 2035. Owners must follow strict architectural rules, pay assessments, and can only lease for 6+ months.
- What you own & maintain: You own your lot and house; the association maintains common areas (open space, stormwater, mail kiosk). The HOA can enter your lot to do maintenance if you fail to keep it up.
- Leasing & rentals: Leases must be at least 6 months. No hotel or transient use. A copy of the lease must be given to the association.
- Architectural review: All exterior changes (buildings, fences, landscaping, paint, etc.) need prior written approval from the Architectural Control Committee (appointed by Declarant until 2035). The committee has 45 days to respond.
- Pets: Dogs, cats, and other household pets are allowed but not for commercial purposes. They must not create a nuisance and must be leashed off your lot.
- Parking & vehicles: No boats, RVs, trailers, or non‑operational vehicles may be stored on your lot. Trucks over 1 ton cannot park overnight. No flammable cargo vehicles allowed.
- Assessments & fees: All owners pay annual assessments (same rate per lot). Special assessments need 1/3 member approval. A $250 working capital fee is due at first sale. Late payments accrue 18% interest and can lead to lien foreclosure.
- Use restrictions: Lots are for residential use only. No home businesses that create noise, traffic, or odors. No temporary structures, outdoor clotheslines, or burning (except in fireplaces/grills). Minimum heated square footage is 1,200 sq ft.
