• Permitted activities in wetlands: A lot owner who obtains a permit from the U.S. Army Corps of Engineers and/or the North Carolina Department of Environment and Natural Resources to construct a pier, dock, or similar improvement may be granted a 10-foot-wide construction easement over conservation wetlands, wetlands, or marsh as necessary to build the improvement consistent with the permit.
• Enforcement & remedies: The U.S. Army Corps of Engineers, its employees, agents, and assigns have the right to enter wetlands or marsh at reasonable times to inspect compliance. However, the Corps cannot bring action against the Declarant or members for injury or change caused by fire, flood, storm, or prudent emergency actions taken in good faith.
