Avondale Townhomes is a townhome community in Wake Forest, NC, governed by a homeowners association (HOA). This declaration of covenants, conditions, and restrictions (CC&Rs) applies to all lot owners, who are automatically members of the Avondale Townhomes Association, Inc. It outlines the rules for property use, maintenance responsibilities, assessments, and architectural control.
- What you own & maintain: You own your townhome unit and lot, but the association provides exterior maintenance for roofs, gutters, downspouts, trees, shrubs, grass, walks, mailboxes, fences, exterior power washing, and painting of doors and trim. You are responsible for maintaining the interior and any exterior items not listed, such as doors, lights, and glass surfaces.
- Assessments & fees: During the Declarant Guarantee Period, the maximum annual assessment is $1,200 per Class A lot ($100/month) and $300 per Class B lot ($25/month). After that period, assessments can be increased with a two-thirds vote of members. Special assessments for capital improvements require a two-thirds vote. Late fees are $25, and unpaid assessments accrue 10% annual interest and become a lien on the property.
- Architectural review: Any exterior change, including buildings, fences, landscaping, or additions, must be approved in writing by the Board or an architectural committee. If no decision is made within 30 days of submission, approval is deemed granted. The Declarant has sole approval authority until it no longer holds Class B membership.
- Use restrictions: Lots are for residential use only; garages cannot be converted to living space. No temporary structures, signs (except small professional signs), or commercial activities are allowed. Playground equipment must be in the rear yard, and no clotheslines or roof penetrations are permitted.
- Pets: You may keep up to three dogs and/or cats total, but they cannot be bred or kept for commercial purposes, and no vicious breeds or exotic pets are allowed. Dog pens and dog runs are prohibited.
- Parking & vehicles: Each unit has two parking spaces. Inoperable or unlicensed vehicles cannot be parked on common areas or streets, and boats or trailers cannot be parked in public rights-of-way. The association may regulate parking of boats and trailers on common areas.
- Insurance: You must maintain insurance on your unit equal to 100% of its insurable replacement value, covering fire and other hazards. The association carries public liability insurance of at least $1,000,000 per occurrence, and premiums are paid through assessments.
- Party walls: Walls shared between units are party walls. Repair costs are shared proportionally by the owners who use them. If a wall is destroyed, any owner who used it may restore it, and others who use it must contribute. Disputes are settled by arbitration.
