The Reserve is a single-family home community in Chapel Hill, NC, governed by a homeowners association (HOA). This declaration of covenants, conditions, and restrictions applies to all lot owners and their guests, and it sets rules for property use, construction, and maintenance.
- Property use & occupancy: Lots must be used only for detached single-family residences, occupied by related persons of the same family plus no more than two unrelated persons. Servant's quarters or a small housekeeping apartment within the main structure is allowed.
- Architectural review: Building plans, specifications, and plot plans must be approved in writing by the Declarant (or later the Association) for conformity and harmony with existing structures. Approval is deemed given if no response within 30 days of submission. Construction must be completed within 12 months of commencement.
- Minimum dwelling size: Each dwelling must have at least 2,000 square feet of heated and finished living area; a two-story structure must have at least 1,000 square feet on the first floor.
- Setbacks & lot subdivision: Buildings must comply with the Chapel Hill Development Ordinance setback distances. No lot may be subdivided, though adjoining owners may adjust a common boundary line if it conforms to the ordinance.
- Parking & vehicles: Only licensed and operative passenger cars, station wagons, passenger pick-up trucks, or passenger vans may be regularly parked in driveways. No regular parking on roadways within the development.
- Pets & animals: A limited number of dogs and cats may be kept on a lot, but not for commercial purposes, and they must not become a nuisance. Pets must be leashed when off the owner's lot.
- Maintenance & appearance: Driveways must be paved before occupancy. Trash and refuse must be stored in screened, enclosed, covered receptacles out of view. No building materials may be stored on a lot longer than reasonable for construction. Temporary structures (e.g., sheds, trailers, tents) require written approval and cannot be used as residences.
- Signs & mailboxes: No commercial signs may be displayed, except signs advertising a lot for sale. Mailboxes and newspaper containers placed apart from the dwelling must be approved by the Declarant.
