Carolina Inlet Acres is a single-family home subdivision in Wilmington, NC. These covenants, conditions, and restrictions (CC&Rs) apply to all lots in Sections 2 and 3, binding current and future owners. The rules cover residential use, building setbacks, mobile homes, lot maintenance, and a mandatory homeowners association that maintains private streets and collects assessments.
- Property use & buildings: All lots must be used exclusively for residential purposes. Only one single-family home or approved mobile home per lot, plus customary accessory buildings. No lot may be subdivided except to combine with an adjoining lot.
- Setbacks & mobile homes: Buildings and mobile homes must be at least 7 feet from side property lines and 40 feet from the front property line or street right-of-way. Mobile homes must be at least 600 square feet of living space, at least 12 feet wide and 50 feet long, placed on a permanent foundation with hurricane anchors, and have enclosed underpinning.
- Lot maintenance & nuisances: Each owner must keep their lot neat and well-maintained. No noxious or offensive activities, nuisances, or annoyances to neighbors. Only usual domesticated household pets are allowed; no livestock or poultry.
- Prohibited structures & vehicles: No bus bodies, shacks, tents, temporary structures, or junked vehicles are allowed on any lot or street in the subdivision.
- Homeowners association & assessments: All lot owners automatically become members of the Carolina Inlet Acres Owners Association, Inc. The association can levy assessments for maintaining private streets, roadways, drainage ditches, and utility rights-of-way. Delinquent assessments bear interest at the maximum legal rate, plus costs and attorney's fees, and can be enforced by a lien on the lot.
- Private streets: All streets in the subdivision are private and owned by the association, unless the association later transfers ownership to the state in exchange for maintenance.
- Amendments & enforcement: The covenants can be amended by a 51% vote of association members. Violations may be enforced by the association or any other lot owner through legal action.
