Cavalier Woods is a single-family home subdivision in Wilmington, NC. These covenants run with the land and bind all current and future lot owners. The document sets rules for residential use, minimum house size, architectural approval, setbacks, pets, fences, and stormwater management.
- Residential use & building type: Lots may be used only for residential purposes. Only one detached single-family dwelling (max two stories, excluding basement) and a private garage for up to three cars are allowed.
- Minimum house size: The heated square footage of any dwelling, excluding porches and garages, must be at least 2,200 square feet.
- Architectural review: Before construction, a sketch showing the plan and outside appearance must be submitted to the developers (or their nominee) for approval. If not approved or disapproved within 10 days, approval is not required, but the design must be in harmony with existing dwellings.
- Setbacks: All dwellings and improvements must comply with front, side, and rear setback requirements of the R-15 residential district as imposed by the appropriate governmental agency.
- Pets & animals: No animals, livestock, or poultry may be raised, bred, or kept on any lot, except dogs, cats, or other household pets, provided they are not kept for commercial purposes.
- Fences: No fences are allowed in the front or sides of any dwelling. Fenced back yards must have a fence in keeping with the dwelling and of good quality construction, and must not extend beyond the rear of the house toward the front.
- Stormwater & impervious surfaces: No more than 7,000 square feet of any lot may be covered by structures or impervious materials (asphalt, gravel, concrete, brick, stone, slate, etc., but not wood decking or swimming pool water surface). Swales may not be filled or piped except for driveway crossings. Excess built-upon area requires a state stormwater permit modification.
- Drainage pond maintenance assessment: Each lot owner is responsible for a pro rata share of maintenance of the drainage pond, assessed periodically and paid to the Pointe Summerset HOA, which may enforce the assessment under its declaration.
