What Forest Park's governing documents say
Forest Park is a single-family home subdivision in Wilmington, NC, governed by a set of restrictive covenants recorded in 1960. These rules apply to all lot owners and are designed to maintain the residential character of the neighborhood.
- Residential use only: All lots must be used for residential purposes only. Only one detached single-family dwelling (max 2½ stories) and a private garage are allowed. No trailers, tents, shacks, or outbuildings may be used as residences.
- Setbacks & lot size: Buildings must be at least 50 feet from the front street line and 10 feet from adjacent property lines. Lots cannot be re-subdivided unless the subdivided part becomes part of a whole lot.
- Minimum house size: Every dwelling must have an interior floor area of at least 1,000 square feet.
- Nuisance & offensive activities: No noxious or offensive trade or activity may be carried on, and no use may become an annoyance or nuisance to the neighborhood.
- Architectural review: Building design must be approved by developer Avgerinos V. Saffo (or successor). If no decision is made within 10 days, approval is deemed given, provided the design is in harmony with existing structures.
- Sewage disposal: Until municipal sewerage is available, sewage disposal must be by septic tank meeting North Carolina State Board of Health approval.
- Duration & amendment: These covenants were binding until November 1, 1980, and automatically extend for successive 10-year periods unless a majority of lot owners vote to change or cancel them.
- Enforcement: Any lot owner may sue to enforce these restrictions, seeking an injunction or damages for violations.
