What Pineywoods's governing documents say
Pineywoods is a single-family home subdivision in Wilmington, NC, governed by a 1967 declaration of restrictions. These rules apply to all lot owners in Section 'H' and are designed to maintain a uniform development pattern.
- Land use & building type: Lots 1 through 45 are for residential use only. Only one detached single-family dwelling (max 2.5 stories) plus a one- or two-car garage may be built per lot.
- Setbacks & lot subdivision: Buildings must be at least 50 feet from the front street line and 10 feet from adjacent property lines. Lots may not be resubdivided unless the subdivided part merges with another whole lot.
- Temporary structures & outbuildings: No trailer, basement, tent, shack, garage, barn, or other outbuilding may be used as a residence.
- Architectural review: Building designs must be approved by the developer or a committee. Approval is automatic if not acted on within 10 days, provided the design is in harmony with existing structures. Dwellings must have at least 1,400 square feet of interior area (with possible exceptions for porch/garage under main roof). Exterior materials are limited to wood, stone, brick, brick veneer, tile and stucco, concrete, or concrete and stucco; garages must match dwelling materials.
- Sewage & drainage: Until municipal sewerage is available, septic tanks meeting state health approval are required. Each owner must install and maintain a culvert or drainage pipe (minimum 12 inches diameter) under their driveway to avoid blocking street drainage.
- Enforcement: Any property owner in the subdivision may sue to enforce these restrictions or recover damages for violations.
- Severability: If any covenant is invalidated by court order, the remaining provisions stay in effect.
