Summer Haven Point is a single-family home HOA in Wilmington, NC. You own your lot and house; the association maintains common areas like roads, drainage, and entry landscaping. All owners are automatically members and must pay assessments.
- Architectural review: All exterior construction, alterations, and landscaping must be approved by the Architectural Control Committee or Declarant. Houses must be at least 2,000 sq ft (excluding garages, porches, decks). Construction must be completed within 12 months. Southern classic styles are preferred.
- Use restrictions: Lots are for single-family residential use only. No trailers, mobile homes, or temporary structures. No satellite dishes or outside antennas without approval. Playground equipment must be wood. No inoperable vehicles or tractor-trailers allowed.
- Pets & animals: No livestock or poultry. Dogs, cats, and household pets are allowed but must be leashed and not kept for commercial purposes.
- Parking & vehicles: Each lot must provide off-street parking for at least 2 cars, constructed of concrete, brick, asphalt, or turfstone. Boats, campers, and trailers must be screened from public view.
- Assessments & fees: Annual assessments are due Jan 1, payable in installments as determined by the association. Special assessments for capital improvements require 3/5 member vote. A working capital assessment equal to one year's estimated assessment is due at closing. Unpaid assessments become a lien on the lot.
- Stormwater & environmental rules: No more than 7,100 sq ft of impervious surface per lot. No structures or paved surfaces within 30 feet of surface waters. These covenants benefit the State of North Carolina and cannot be changed without state consent.
- Tree & vegetation protection: No trees, bushes, or shrubs with a diameter of 4 inches or more may be removed without approval, except diseased or dead ones. A landscaping plan must be approved, with preference for native species.
