The Cottages at Hewlett's Creek is a single-family home HOA in Wilmington, NC. This document is the Declaration of Restrictive Covenants that applies to all lots in the subdivision. It establishes rules for property use, architectural control, and an owners' association with mandatory assessments.
- Architectural review: All building plans, exterior colors, landscaping, and site alterations must be approved in writing by the Declarant or Architectural Committee. Refusal can be based on any grounds, including aesthetics. Minimum house size: 2,000 sq ft (one-story) or 2,300 sq ft (two-story). Front setback: 50 ft; side setback: 10 ft. Exterior must be completed within 12 months of starting construction.
- Residential use & restrictions: Lots are for single-family detached dwellings only (max 2.5 stories). No apartments, duplexes, trailers, mobile homes, or temporary structures. No business, professional office, or religious use. Accessory buildings (e.g., pool house, guest quarters) allowed only after main house is built.
- Assessments & fees: Each lot owner must pay annual assessments set by the Association, due January 1 (may be paid in installments). Unpaid assessments become a lien on the lot and accrue 12% interest. The Association can levy additional assessments for emergencies. Budgets must be ratified by lot owners; if 80% reject, the prior budget continues.
- Maintenance & nuisances: Owners must keep lots clean and free of unsightly conditions. No noxious or offensive activities. Weeds and brush must be cut; if owner fails, Declarant may do so and charge owner, with lien rights.
- Parking & vehicles: No trailers, boats, or habitable motor vehicles may be parked on the property unless inside an enclosed garage. This applies to common easement areas as well.
- Pets & animals: No plants or animals that are noxious, dangerous, unsightly, or diminish enjoyment of the property are allowed.
- Other restrictions: No exterior aerials or satellite dishes without approval. Clotheslines must not be visible from street or common areas. No firearms or hunting. Mailboxes require Declarant approval. Lots cannot be subdivided without consent.
