Horton Heights is a single-family home HOA in Wake County, NC, governed by a Declaration of Covenants, Conditions, and Restrictions. This document binds all lot owners and sets rules for property use, maintenance, and assessments. It is the full rulebook for the community.
- What you own & maintain: You own your lot and home; the HOA maintains common open space, stormwater devices, and entrance signs. You must keep your lot neat, and the HOA can fine you for tall grass (8+ inches) or other unkempt conditions.
- Assessments & fees: Annual assessments start at $400 per lot, can rise up to 10% per year without a vote, and higher increases need a 2/3 vote. Special assessments for capital improvements also require 2/3 approval. A working capital fund equal to at least 2 months' assessment is collected at closing.
- Architectural review: Any building, fence, sign, or other structure needs prior written approval from the Architectural Control Committee. Plans are deemed approved if not acted on within 60 days. Minimum heated area is 2000 sq ft (1600 for certain original lots), and each home must have a two-car garage and paved driveway.
- Use restrictions: Lots are for single-family residential use only. No commercial activity, no outbuildings without approval, no chain-link fences without approval, and no satellite dishes over 24 inches. Garbage receptacles must be out of view from the street.
- Parking & vehicles: No street parking; owners must provide off-street parking. Boats, trailers, and RVs cannot be parked in front or beside the house, and must be screened from view. Inoperative or abandoned vehicles are prohibited.
- Pets: No livestock or poultry. Household pets limited to two cats or two dogs (or one of each). Pets must be controlled by fence, leash, or harness, and owners must clean up after them in common areas.
- Fines & enforcement: Fines start at $50 for first violation, up to $100 for second, and $100 per week for continuing violations. The HOA can also place a lien on your lot for unpaid assessments and foreclose.
