This document is a partial set of rules — a supplement to the community manual and the association's bylaws — that outlines procedural policies and the board's governance structure. It does not contain the full declaration or all community rules, but it governs how the HOA handles violations, architectural approvals, meetings, finances, and owner rights.
- Covenant violation hearings: If an owner receives a violation notice, they may request a hearing within 30 days. The association must provide documentation it will use. Hearings follow a set procedure; audio recordings allowed with disclosure.
- Architectural review: Architectural reviewers cannot be board members, board members' spouses, or household members. Owners denied an application have a right to a hearing before the board within 10 days. The board may affirm, modify, or reverse the decision.
- Board meeting notice & open meetings: Board meetings require at least 10 days' notice or 72 hours if notice is posted. Certain actions (fines, foreclosure, assessment increases, budget approval over 10%, etc.) must be discussed in an open meeting with prior notice. - Bid procedures for contracts over $50,000: Contracts for services costing more than $50,000 require specific bidding procedures, including a deadline and at least 7 days for vendors to submit bids.
- Pool fencing & security devices: Pool enclosures and security fencing need architectural approval. The association may not deny a swimming pool enclosure if it meets state/local safety requirements and is black in color. Security measures (cameras, motion detectors) also require approval.
- Delinquent assessment notices & credit reporting: The association must provide a 45-day cure notice before reporting a delinquency to credit agencies. Notice must be sent at least 30 business days before reporting. Payment of delinquent assessments is applied first to delinquent assessments, then current assessments, then fees.
- Religious displays: Owners may display religious items based on sincere religious belief, as long as they don't threaten health/safety, violate law, or contain patently offensive content. The association may remove items that violate these terms.
- Board structure & owner voting: The board has 3 directors initially, with Declarant appointing two-thirds until the Development Period ends. Owners then elect directors for staggered terms. Voting may be in person, by proxy, by absentee ballot, or electronically. Elections must be tabulated by an independent party.
