What Ashbriar's governing documents say
Ashbriar is a single-family home HOA in Tarrant and Parker Counties, Texas. This document is the main rulebook (Declaration of Covenants, Restrictions, and Easements) plus a 2004 amendment that increased the minimum residence size from 2,500 to 3,000 square feet. It applies to homeowners, not renters directly, but renters must follow these rules.
- What you own & maintain: You own your tract (at least 1 acre), the residence, and any structures. The HOA maintains common roads, entrance gates, and common property. You must maintain your own property, including landscaping and structures.
- Architectural review: All exterior construction, alterations, fences, pools, sheds, and even landscaping must be approved in writing by the Restrictions Review Committee (RRC) before starting. Plans must show site plan, materials, and setbacks. The RRC can charge review fees.
- Assessments & fees: Annual assessment starts at $600 per tract (Lot 2 is $100). The HOA can raise it up to 20% per year without member vote. Special assessments require approval by 55% of members present at a meeting. Late payments accrue 18% annual interest and can become a lien on your property.
- Land use & building restrictions: Tracts are for single-family residential or agricultural use. Minimum residence size is 3,000 sq ft (excluding porches, garages, in-law quarters). An in-law residence is allowed if attached and matching materials. Construction must be completed within 365 days. No trailers, mobile homes, or temporary structures used as residences.
- Parking & vehicles: No large commercial vehicles, buses, or commercial trucks may be parked on any tract or common roads. Recreational vehicles, boats, trailers must be stored in an enclosed structure approved by the RRC. No junk vehicles or appliances. Motorcycles and ATVs allowed only on paved streets and must be street-legal with mufflers.
- Pools & recreational facilities: Pools and spas require written RRC approval. No above-ground pools except children's small play pools. Athletic facilities (basketball goals, swing sets, sports courts) allowed only between rear property line and back of residence unless RRC approves otherwise. Tennis court lighting needs prior approval.
- Enforcement: Violations trigger a 30-day notice letter. If not fixed, the HOA can enter your property to fix the issue and bill you, plus 18% interest and legal fees, secured by a lien. The HOA can also sue for injunctive relief. Owners waive certain rights to judicial hearing before sale under the lien.
