Richardson Ranch Estates is a single-family home subdivision with large lots (minimum 3 acres) in Benbrook, TX. This Declaration of Covenants, Restrictions, and Easements establishes the homeowners association and sets rules for the community. The rules apply to all lot owners and residents.
- Lot & residence requirements: Each lot must be at least 3 acres. Only one primary single-family residence per lot, with a minimum of 2,500 square feet of living space (excluding porches and garages). Garages must hold at least two cars and be rear or side entry. Construction must be completed within 365 days.
- Architectural review: All structures and exterior alterations require prior written approval from the Restrictions Review Committee (RRC). Plans must include site plan, building setbacks, and material specifications. The RRC may impose review fees.
- Assessments & fees: Each lot is subject to an annual assessment initially set at $600. The assessment may be increased by up to 20% in any 12-month period without member approval (with Declarant's consent) or by more with 50% member approval. Special assessments require 55% member approval (while Declarant has appointment rights). Unpaid assessments accrue interest at up to 18% per annum and create a lien on the lot.
- Animals: Up to one large animal per acre is allowed, but no swine. Commercial feed lots or kennels are prohibited. Animals must be fenced or leashed, and hunting is prohibited.
- Landscaping & maintenance: Landscaping must be completed within 120 days after the dwelling is 90% complete. Owners must maintain landscaping in healthy condition. The association may enter and correct violations at owner's expense.
- Vehicles & parking: Large commercial vehicles, buses, RVs, boats, and trailers may not be parked on lots unless screened or in a garage. Motorcycles and ATVs are limited to on-road use with mufflers (max 80 dB). No off-road use on common property without written consent.
- Signs: Only one 'For Sale' sign (max 6 sq ft) is allowed per lot without RRC approval. Temporary signs (garage sales) are limited and must be removed promptly. No signs on common property without RRC approval.
- Enforcement & liens: Violations are enforced via written notice, with 30 days to cure. The association may enter and abate violations, charging owner for costs plus interest. Unpaid assessments can be foreclosed via nonjudicial power of sale (owner waives hearing rights).
