What Dallas Land's governing documents say
Westwood at Bishop Arts is a condominium community in Dallas, TX — a 7-unit building where you own the interior of your unit and share ownership of the building's common elements with other owners. The association manages the common areas, carries master insurance, and levies assessments. This document is the primary rulebook for unit owners.
- What you own & maintain: You own the interior of your unit (walls, floors, systems only serving your unit). The association maintains the common elements (building structure, roof, grounds) and carries property and liability insurance. You must maintain, repair, and clean your unit; failure gives the association the right to enter and fix at your cost.
- Assessments & fees: The association sets a monthly assessment to cover common expenses, and may levy special assessments for non-recurring costs. Each unit's share is equal (14.2857% per unit based on 7 units). Delinquent payments incur interest at 18% per annum and can become a lien on the unit, enforceable by foreclosure.
- Leasing & rentals: Leasing is permitted but subject to restrictions in the governing documents. Owners are responsible for their tenant's compliance with all rules. The association can demand that an owner collect rent to cover unpaid assessments.
- Alterations & approvals: You must obtain prior written approval from the association before making any structural or material changes to your unit, including changes to floor plan, exterior, or common elements. All work must comply with approved plans and legal requirements. The association is not liable for design or safety defects in approved work.
- Dispute resolution: Most disputes (except construction-related) are first submitted to non-binding mediation, then to binding final-offer arbitration if unresolved. Construction disputes are mediated and then arbitrated or litigated at the declarant's option. Arbitration awards are enforceable in court, and the losing party typically pays costs and fees.
