This document is a restrictive covenant agreement between the owner of 516 Magnolia Parkway in Benbrook, TX and the builder (McBee Homes). It is NOT a community-wide set of rules — it binds only the two parties to this single property. The agreement focuses on mandatory dispute resolution, disclaimers of implied warranties, and a release of liability for mold and biological impurities.
- Mandatory dispute resolution: Any dispute between owner and builder must first go to mediation, then binding arbitration under the Federal Arbitration Act or AAA rules. Filing a court action does not waive the right to demand arbitration.
- Warranty disclaimers: Builder makes NO implied warranties of habitability, fitness, or good workmanship. Any implied warranties allowed by law are limited to 2 years from conveyance. Only express warranties in the sales contract apply. Manufacturer warranties on equipment are also disclaimed.
