What Indian Spring Estates's governing documents say
Indian Spring Estates is a single-family residential subdivision in Briaroaks, TX, governed by a Declaration of Covenants that runs with the land. The rules apply to all lot owners and restrict how lots can be used, subdivided, and built upon. There is no homeowners association; enforcement is by lot owners and the declarant.
- Lot size & subdivision: No lot may be divided into parcels smaller than one acre. Two or more adjoining lots may be consolidated into building sites of at least one acre each, with all necessary governmental approvals.
- Type of buildings permitted: Only one detached single-family dwelling not exceeding two stories may be built per lot. Outbuildings detached from the main residence are allowed if made of new materials. No mobile homes, manufactured homes, or modular homes are permitted.
- Minimum floor area & setbacks: Any residence must have a minimum living area of 1,000 square feet, excluding porches, garages, and outbuildings. Setbacks follow the recorded plat; no side yard at the front building line may be less than 10 feet (2 feet for a garage located 50 feet or more from the front property line).
- Home-based businesses: Commercial use is prohibited, but one home-based business may operate from the main dwelling, limited to one room. It may generate no more than six vehicle trips per day; no items may be displayed outside. Garage/yard sales are limited to three days per six-month period. Prohibited businesses include vehicle repair, commercial animal breeding, any business creating noise or odor at the lot line.
- Animals: Livestock is allowed: one head of cattle or horse per acre, 20 chickens per acre, with a cap of 10 animals per lot unless part of a 4‑H or FFA program. A maximum of six dogs and cats (in aggregate) per lot, plus one litter of puppies or kittens under 10 weeks old. Commercial breeding is prohibited.
- Floodplain & drainage: No house shall be built in a 100‑year floodplain unless at least three feet above the floodplain elevation. No building, fill, or obstruction is allowed in the floodway. Lot owners must maintain open channels and drainage courses on or adjacent to their lots. Johnson County has no duty to maintain drainage or is liable for flood damage.
- Road maintenance: Interior roads are privately constructed and maintained by property owners unless formally accepted by the county. Filing a plat does not constitute acceptance for county maintenance.
- What this document doesn't cover: There is no homeowners association, common property, or monthly/annual assessments. The document does not restrict leasing, pets beyond the animal limit, parking, or architectural review (only a requirement that house numbers be visible and reflective).
