Forgotten Farm Estates is a single-family residential subdivision in Johnson County, Texas. These deed restrictions (not an HOA) run with the land for 40 years, automatically extending 20 years at a time, and apply to all lot owners, their guests, and invitees.
- Use restrictions: Lots are for single-family residential purposes only. No subdivision into smaller tracts, no commercial agricultural businesses (like feed lots or hog operations), and no commercial animal keeping. Home-based businesses are allowed only if they have no exterior sign, no additional traffic, and no toxic substances stored on the property.
- Construction requirements: Main residences must be at least 1,000 sq. ft. inside outside walls and have a minimum of 3 feet of masonry wainscot on the front exterior. Exterior must be completed within 12 months of slab pour. Upon start of construction, exterior must be completed within 12 months and built to applicable codes.
- Tiny houses, modular cabins, and temporary structures: One tiny house or modular cabin (400–1,000 sq. ft.) may be placed per lot before the main residence is built, but cannot be the main residence and can only be occupied for up to 6 months per year. There is no minimum square footage for a tiny house. Travel trailers and RVs may be stored temporarily (max 6 months per year) before the main residence is built; after construction, all boats, trailers, and RVs must be stored behind the residence.
- Vehicles and storage: No lot may be used as a junk yard. Vehicles under extended maintenance must be kept in a garage or utility building. Boats, trailers, RVs, and hobby vehicles may not be parked on the lawn, driveway, or street for a prolonged period; prolonged storage must be in a garage or hidden behind a fence. Only routine vehicle maintenance (not exceeding a short period) is permitted in public view.
- Landscaping and maintenance: Front yard must be landscaped within the first year of occupancy. Lawns must not exceed 6 inches in height. All residences must have a brick or cast iron mailbox. No signs in public view except one professional sign (max 2 sq. ft.) or two sale/rent signs (max 5 sq. ft. each), plus builder signs during construction.
- Animals: Household pets are allowed. Additionally, per acre: up to 1 horse, 1 cow, or 2 goats for personal use, but no commercial production. Chickens are allowed for personal use only, must be contained behind the home and not a nuisance. Pigs and peacocks are prohibited. All animals must be fenced or kept in clean, sanitary enclosures.
- Home businesses: Any activity for profit must be related to single-family residential use or agriculture, with no exterior sign, no additional traffic, and no toxic substances. Home offices that comply are permitted. Customary sales activities for selling homes in the subdivision are not restricted.
- Amendment and duration: Restrictions run for 40 years from recording (May 2019) and automatically extend for successive 20-year periods unless cancelled by a vote of tract owners. Amendments require a two-thirds majority vote, but the Developer has the right to unilaterally amend so long as it is consistent with the general plan of development. The Developer may also grant variances on a case-by-case basis.
