Happy Trails Addition is a single-family residential subdivision in Johnson County, Texas, governed by amended restrictive covenants filed by at least 75% of homeowners acting through the Happy Trails Homeowner’s Association. These covenants run with the land and bind all current and future property owners.
- Land use restrictions: All lots are for single-family residential use only. No business, trade, or commercial activity that is loud or offensive is allowed. Sexually oriented businesses and commercial sale or service of alcoholic beverages are prohibited.
- Animals: All animals must be fenced in or chained; they shall not be allowed to run loose or unattended.
- Building standards: Construction must meet the National Building Code, National Electronic Code, National Plumbing Code, and ASRA standards. Mobile homes must be tied down per state specifications. All additions, outbuildings, and structures must be completed in a professional manner and be neat in appearance. No building may be located on road or utility easements. Driveways must be kept clear by the owner for drainage.
- Trash and maintenance: No trash or refuse may be dumped on any lot. Each owner must keep their lot in a presentable condition. Wells and septic tanks must conform to state health regulations.
- Easements: Easements for installation and maintenance of utilities and drainage facilities are reserved. No building may be placed on any road or utility easement.
- Duration and amendment: These covenants run with the land until January 1, 2008, and automatically extend for successive 10-year periods unless a majority of lot owners record an instrument to change them in whole or in part.
- Enforcement: Any property owner in the subdivision may sue to enforce or prevent violation of these covenants. A successful party may recover damages from the violator.
