Walnut Creek Estates is a single-family residential subdivision in Johnson County, Texas, governed by a Declaration of Covenants, Conditions and Restrictions (Phase I and Phase II). These rules apply to all lot owners and are designed to ensure uniform development and property standards.
- Residential use & minimum house size: Only single-family site-built dwellings are allowed. Minimum living space: 2,000 sq ft for single-story, or 1,600 sq ft ground floor plus 600 sq ft upper floor for two-story homes (excludes garages, porches, etc.). Maximum 2 stories, and a minimum attached two-car garage with side or rear entry is required.
- Construction standards & architectural review: Exterior walls must be at least 75% brick or masonry; roof material must be 240 lb laminated shingle or better (white not allowed), with a minimum 6:12 pitch. Exterior must be completed within 9 months of groundbreaking. All structures, fences, and alterations require Architectural Committee approval.
- Outbuildings & setbacks: Barns, garages, or outbuildings may not be constructed until primary residence is at least 50% complete; they must be at the rear and approved. No barn within 100 ft of a residence. Setbacks: at least 50 ft from front property line, 20 ft from side and rear lines.
- Temporary structures & lot consolidation: No temporary structures (e.g., trailers, mobile homes, tents, shacks) are permitted. Lots may be consolidated only if resulting site is at least 2.5 acres with 150 ft frontage; declarant retains right to redivide.
- Vehicles & parking: No unlicensed vehicles may remain for over 30 days. Recreational/commercial vehicles (boats, campers, trailers, trucks) must be stored behind the primary dwelling and not visible from the street. Phase II also prohibits ATVs on roads, ditches, or vacant lots.
- Animals & livestock: Per acre: up to 2 small animals (e.g., calf, emu) each ≤400 lbs, or 1 cow/horse. No hogs, sheep, or other livestock. Up to 2 outside dogs/cats allowed if confined. No commercial kennels. Owner must reside on the lot or adjacent lot to keep animals.
- Lot maintenance & enforcement: If a lot is not built on, front 1/3 must be regularly mowed. Declarant may mow and file a lien for costs plus 15%. Covenants run with the land for 20 years (from recording), auto-renewing for 10-year periods. Amendment requires 90% lot owner approval in first 20 years, 75% thereafter; declarant may amend for 7 years.
