This is a deed-restricted subdivision (The Homesteads at Blackberry Springs) in rural Johnson County, Texas. The covenants apply to all property owners in the 464-acre tract. There is no homeowners association; enforcement is by individual owners. Lots are minimum one acre, and the covenants run for 30 years, auto-renewing.
- Architectural Control: An Architectural Control Committee (ACC) must approve plans for any structure, including prefabricated homes, for quality, harmony, and location. Plans are deemed approved if no response within 30 days. The ACC can waive restrictions.
- Animals & Livestock: Maximum of two animals per acre (e.g., 18 animals on 9 acres). Owners may keep up to 25 chickens and up to 3 cats/dogs per property regardless of acreage. Fighting roosters and swine are prohibited. All animals must be in a fenced enclosure.
- Parking & vehicles: No trucks, buses, boats, or trailers (except personal-use passenger vans) may be parked where visible from a street or roadway unless parked at least 200 feet back. Work vehicles may park near construction sites. All vehicles must have current license, registration, and inspection.
- Setbacks & Building Restrictions: Dwellings must be at least 1,000 sq ft living area. Front of home must be 50-100 ft from front property line and 25 ft from side property lines. Metal roofs require button tie-downs. No tires or objects on roofs. Only new structures are allowed; manufactured homes must be new. All barns/outbuildings must be compatible and maintained.
- Business & Nuisance: No trade or business is allowed, except the purchase or sale of livestock. No noxious or offensive activity; horse-related activities are exempt. No billboards or advertising structures.
- Maintenance & Weeds: Grass, weeds, and vegetation must be kept mowed. If not maintained, the ACC may have them cut and charge the owner, creating a lien on the property.
- Duration of Restrictions: These covenants run with the land for 30 years from recording date (July 1997) and automatically renew for successive 10-year periods unless changed by an instrument signed by two-thirds of owners (by acreage).
