What Shannon Creek Phases 1-5's governing documents say
Shannon Creek Phases 1-5 is a single-family home community in Burleson, TX, governed by a Common Area Maintenance Owners Association. This document creates the HOA, which manages and maintains only the common areas (entrance, greenbelt). Homeowners automatically become members and pay assessments for that limited purpose. This is NOT a full set of HOA rules—it does not regulate homes, pets, rentals, or use of lots.
- Association & membership: Every Lot owner in Shannon Creek Phases 1-5 automatically becomes a member of the Shannon Creek Common Area Maintenance Owners Association. Membership is tied to lot ownership and cannot be transferred separately.
- Voting & board: Each lot owner has one vote. The Association must hold at least one annual meeting to elect a 3-member Board of Directors and discuss business. The Board manages the Association and can adopt rules for common area maintenance.
- Assessments & liens: The Association can levy regular assessments on all owners to cover common area expenses. Unpaid assessments can become a lien on the owner's lot, which the Association may foreclose upon.
- Common area maintenance: The Association's sole purpose is maintaining the Common Areas (entrance and greenbelt lots) in a state of high quality and good repair. It must also insure, pay taxes, and manage those areas.
- Duration & amendments: These covenants run for 20 years from the recording date (December 2018) and automatically renew for successive 10-year periods. They can be terminated or amended by an instrument signed by more than 75% of the owners and recorded in the county.
- What this document doesn't cover: This declaration does NOT include any rules about architectural control, landscaping, parking, pets, noise, rental restrictions, or use of individual lots. Those would be in a separate set of covenants or regulations, if they exist.
