This is the Declaration of Condominium for Quorum View Condominiums, a 19-unit condominium community in three buildings in Carrollton, Texas. It binds all unit owners and occupants and covers what you own and maintain, leasing rules, pet limits, parking, alterations, and assessments.
- What you own & maintain: You own the finished interior of your unit (walls, floors, ceilings, fixtures, and appliances). The association owns and maintains the common elements (roofs, exterior walls, grounds, pool, etc.) and carries master insurance. You must maintain your unit's interior and any patio/balcony/storage space; the association has a right of entry for repairs.
- Leasing & rentals: Leases must be in writing, cover the entire unit, and be for at least 30 days (no hotel/transient rentals). Lessees must agree to follow the declaration and by-laws; the owner remains liable for obligations.
- Pets: No livestock, reptiles, or poultry. Domestic pets (dogs, cats, fish, birds) are allowed, but typically no more than two per household. The association can limit size/weight and ban pets that become a nuisance. Animals must be leashed or in an enclosure; owners must clean up after them and are liable for any damage.
- Parking & vehicles: Vehicles must be parked only in designated spaces. Inoperable vehicles, large commercial vehicles (dump trucks, cement mixers), RVs, and other large vehicles are prohibited without board approval. Motorcycles and motorbikes may only be driven to and from parking spaces.
- Alterations & approvals: You cannot alter or modify common elements (including exterior appearances) without prior written board approval. Structural changes are prohibited. The board has 30 days to respond to a request; silence means approval.
- Assessments & fees: Monthly assessments are due by the 1st; a $5 late fee applies after the 15th. Annual increases are limited to 120% of the prior year's assessment unless approved by a two-thirds vote of owners. Special assessments for capital improvements also require a two-thirds vote.
- Use & appearance restrictions: Units must be used as one-family residences only. No temporary structures, exterior clutter, visible clotheslines, or stored items in common areas without consent. No noisy or offensive activities; the association can regulate noise and visual attractiveness.
