This is a partial amendment to the declaration for Cedar Mill Homeowners Association, a standard single-family HOA in Cedar Hill, TX. - Complaint procedure: The Board must provide written notice to the complaining owner of the time, date, and place of the meeting to discuss the complaint. The owner must appear. If unresolved, either party may submit to binding arbitration.
- Binding arbitration: All disputes under the Declaration and Bylaws must go to binding arbitration at JAMS in Dallas. Each party may appear without an attorney, has one hour to present its case, and may not appeal the arbitrator's decision. Arbitration must be initiated within one year after the breach or it is barred. Fees are paid by the nonprevailing party; each pays its own costs and attorney fees. No punitive damages are allowed.
