What Windsor Park II HOA's governing documents say
This document is the Covenant Enforcement and Fining Policy for Windsor Park II Homeowners Association in Cedar Hill, TX — a standard single-family HOA. It sets out the formal process for handling rule violations, including warnings, fines, hearings, and appeals. Homeowners should understand the steps the association will follow when issuing fines and the rights to contest them.
- Violation process & notices: Violations are verified by a field observation. A courtesy notice gives at least 10 days to cure. If not cured, a formal Notice of Violation is sent by regular and certified mail, stating the violation, proposed fine, and the right to request a hearing within 14 days.
- Fines & escalation: Fines start at $25 for the first violation. If not cured within 14 days, fine increases to $50 with 7 days to comply; then $100 with 3 days; then an additional $100 every 10 days until compliance. Fines become a personal obligation of the owner and are collected like assessments.
- Hearings & appeals: An owner may request a hearing within 14 days of the Notice of Violation. The hearing is held in executive session within 14 days of the request, with at least 7 days' notice. After a delegate's hearing, the owner may appeal to the Board within 10 days of the written decision.
- Corrective action by association: If the Board determines a violation can be readily corrected, it may enter the property to abate it after giving prior written notice. The association is not liable for trespass or damages from such action.
- Legal referral: The Board may refer violations to legal counsel at any time for demand letters, filing notices on the property records, or seeking injunctive relief. Attorney's fees and costs become the owner's personal obligation.
- Notice requirements: Notices are deemed given upon personal delivery, or three calendar days after first-class postmark. If no designated address, notices may be taped to the front door. Owners remain liable even if they sell the lot during proceedings.
- Cure of violation during enforcement: An owner may correct the violation at any time. Once verified, the violation is deemed cured, but the owner remains liable for all costs and fines incurred up to that point.
- What this document doesn't cover: This policy only covers enforcement and fines — it does not list the specific rules (e.g., about pets, parking, landscaping, or leasing) that could be violated. Those rules are in the Declaration, Bylaws, and separate Rules and Regulations.
