What Bellevue Crest's governing documents say
This document is a set of Covenants, Conditions & Restrictions (CC&Rs) for Section 8 of the Bellevue Crest Addition, a single-family residential subdivision in Cleburne, Texas. It binds all lot owners and governs what you can build and how you can use your property. The restrictions run with the land and were recorded in 1964, with automatic 10-year renewals unless a majority of owners changes them.
- Use of lots & buildings: Lots may only be used for residential purposes; no business or commercial activity. Only single-family or two-family dwellings are permitted, not to exceed two stories, plus garages and servants' quarters.
- Minimum lot & dwelling size: No residential structure may be placed on a lot smaller than 7,500 square feet. The main dwelling must have a ground floor area of at least 1,200 square feet, excluding open porches and garages.
- Architectural control committee: Plans and specifications for any building, fence, or wall must be approved in writing by a three-member Architectural Control Committee (initially named in the document). If the committee fails to approve or disapprove within 30 days of submission, approval is deemed given. A majority of lot owners can change the committee's membership.
- Setbacks: No building may be located nearer to a street line than the setback shown on the recorded plat, and no nearer than 5 feet to an interior lot line. Steps and open porches are not counted as part of the building for setback purposes, but no part of a building may encroach on another lot.
- Prohibited uses & structures: No trailers, basements, tents, shacks, barns, garages, or outbuildings may be used as residences. No house may be moved onto a lot from another location. Oil drilling, mining, and related activities are prohibited.
- Pets and nuisance: Only household pets are allowed. No nuisance or obnoxious/offensive activities are permitted on any lot.
- Duration and changes: These restrictions originally ran for 35 years from January 1964 and automatically renew for successive 10-year periods unless a majority of lot owners record an instrument modifying or releasing them.
