Westhill Terrace is a single-family home subdivision in Cleburne, TX, governed by deed restrictions that run with the land. These rules apply to all lot owners and set standards for construction, use, and maintenance. The restrictions are enforced by an Architectural Control Committee and are binding for 35 years, auto-renewing every 10 years unless modified by a majority of lot owners.
- Residential use only: All lots are for residential purposes only; no business or commercial activity is permitted.
- Minimum house size & construction materials: Homes must have a minimum living area of 1,200 square feet (exclusive of porches/garages) and be at least 50% brick, rock, or masonry. Detached garages and other buildings may be of good new construction but do not need the 50% masonry requirement.
- Setback & fence rules: Buildings must comply with city zoning setback lines; fences cannot be placed closer to the street than the building setback line without written approval from at least two members of the Architectural Control Committee. Minor violations may be waived by the Committee.
- Temporary structures & moved homes: No trailer, basement, tent, mobile home, shack, barn, garage, or other outbuilding may be used as a residence. No house may be moved onto a lot from another location.
- Mineral operations prohibited: No oil drilling, mining, or related structures are allowed on any lot unless all lot owners unanimously approve in writing.
- Parking & vehicle restrictions: No lot may be used as a junkyard or for selling/storing used cars. Trucks and trailers (except pickup trucks) may not be parked on any street or lot.
- Pets: Only household pets are allowed; no nuisance or offensive activities are permitted.
- Architectural Control Committee: All construction or alterations require prior written approval from the Architectural Control Committee regarding quality, design, and location. If the Committee does not respond within 30 days, approval is deemed granted. The Committee may also grant variances on setbacks, house size, and materials if all abutting lot owners consent.
