What B 1 Las Casas Jardines's governing documents say
This is a single-family home subdivision in Colleyville, TX, governed by a Declaration of Covenants, Conditions, and Restrictions (CC&Rs) and an amendment. The rules apply to all lot owners and are enforced by an Architectural Control Committee. Key restrictions cover building design, lot use, and mandatory assessments for a private access drive.
- Architectural review: No building, fence, wall, or other structure may be erected or altered without prior written approval from the Architectural Control Committee. Plans and specifications must be submitted; if not approved or rejected within 30 days, approval is deemed given.
- Building requirements: Only single-family detached dwellings are allowed, no more than two stories. Minimum ground floor area is 1,000 square feet (excluding porches, garages, etc.). Exterior walls must be at least 50% masonry; roofs must be fireproof. Setbacks must meet the recorded plat or City of Arlington zoning, whichever applies.
- Use restrictions: Lots are for residential use only – no professional, business, or commercial activity inviting the public. No mobile homes, trailers, or temporary structures. No oil drilling or mining. No noxious or offensive activities. No dumping of rubbish; garbage must be kept in sanitary containers.
- Pets: Dogs, cats, or other household pets may be kept, but not bred or maintained for commercial purposes. Livestock and poultry are prohibited.
- Signs: Only one sign of not more than 5 square feet advertising the property for sale or rent is allowed, except that the declarant may install signs during development.
- Fences & walls: Fences, walls, and hedges cannot be placed nearer to the street than the main residence, unless approved by the Architectural Control Committee or part of a decorative subdivision entry.
- Assessments & fees: An annual assessment (initially $12 per lot) is levied for maintenance of the private access drive. Special assessments for capital improvements may be approved by one-half of lot owners. Assessments are a lien on the property and personal obligation of the owner. Delinquent assessments bear 10% interest.
- Party walls: If a home is built with a party wall on the lot line, the adjoining owners share maintenance and repair costs proportionally. Disputes are resolved by arbitration.
