Highmeadow Village, Phase X is a single-family home community in Aubrey, TX, governed by a homeowners' association (Highmeadow Village Phase X Maintenance Association, Inc.). Residents must own their lot and detached house; the association maintains limited common areas (detention ponds) and enforces rules on architecture, land use, and assessments.
- Architectural review: All exterior construction, additions, fences, and alterations require prior written approval from a 3-person Architectural Control Committee appointed by the Declarant. Plans must show harmony of design and location. If the committee neither approves nor disapproves within 30 days of submission, approval is deemed given.
- Construction standards: Homes must be new construction with a minimum of 1,200 square feet of air-conditioned living area (excluding porches, patios, etc.), a double-car garage, no more than 2 stories, and a roof pitch of at least 6:12. All roofs must be slate, composition/asphalt shingle, or other permanent type approved by the committee.
- Setbacks & lot use: Buildings must be set back at least 25 feet from the front lot line, 15 feet from side streets, and 6 feet from adjoining property lines (city minimums control if stricter). Lots cannot be re-subdivided. Only one detached single-family dwelling, a private garage (max 3 cars), and approved outbuildings are allowed per lot.
- Landscaping & fences: No fences in front of the residence. Rear yards must have a 6-foot wood privacy fence on lot lines. Chain link fences are prohibited. All fences must be kept in good repair. No open burning of trash; garbage must be kept in sanitary containers.
- Parking & vehicles: No trucks larger than 1-ton pickup, 3/4-ton van, boat, or trailer may park on the street except during construction or repair. Vehicles cannot be parked in yards visible from the street (driveway parking is allowed). Unlicensed, unregistered, or inoperable vehicles may not be stored on lots; vehicles in disrepair visible from the street for more than 14 consecutive days are prohibited.
- Pets & animals: No farm animals, exotic animals, reptiles, livestock, or poultry of any kind may be raised, bred, or kept on any lot.
- Signs & antennas: No signs visible to the public except one professional sign of not more than 4 square feet advertising the property for rent or sale. Temporary signs by the Declarant or builder during construction are allowed. No television, radio, or other antenna may be maintained in front of the residence.
- Association assessments & finances: Each lot owner pays annual assessments set by the Board (plus a one-time working capital contribution of 1/4 the annual assessment at purchase). Assessments fund maintenance of common areas (detention ponds), reserves, insurance, and enforcement. Special assessments may be levied for capital improvements. Delinquent assessments accrue interest at the Default Interest Rate (10% + prime) and carry a lien on the lot, subordinate to mortgages.
