What Ladera at Highland Village Condominium's governing documents say
This is a set of two amendments to the Condominium Declaration for Ladera at Highland Village Condominiums, a condominium community in Copper Canyon, TX. These documents modify certain rules for unit owners, including leasing restrictions and governance. They are not the full governing documents; the base declaration remains in effect.
- Leasing & rentals: Leases must be for at least 6 full consecutive months and for the entire unit. Timeshare use is prohibited. During the marketing period, the declarant may lease units for any term (including overnight). Lessees must comply with all association rules. A previous prohibition on leasing to registered sex offenders was removed.
- Governance (Declarant control): The declarant controls the board until 120 days after 75% of units are sold to non-declarant owners, at which point owners elect a board of at least 3 members. At 50% sold, at least one-third of board members must be elected by non-declarant owners.
- Ownership interests: Each unit has an equal undivided interest in common elements, common expenses, and votes. If units are added or withdrawn, interests are automatically reallocated to keep them equal.
- Condemnation: If part of a unit is taken by condemnation, the unit's allocated interest is reduced proportionally, and the divested interest is reallocated among remaining units (including the partially taken unit on its reduced basis).
