What Shoal Creek Homeowners's governing documents say
This is an amendment to the Shoal Creek Homeowners Association (Double Oak, TX) fining policy only — it replaces the 2003 fining policy with a new Covenant Enforcement Policy and Fining Schedule. The full community rules (declaration, bylaws, etc.) are not included here; this document governs how violations are identified, fines are levied, and hearings are conducted.
- Fines & maximum amounts: Maximum fine per violation is $500. Initial fine for most curable violations is $50; for uncurable violations it is a one-time $50. Second and subsequent fines double for each inspection up to the $500 cap.
- Categories of violations: Fines are set for categories: Single-Family/Business Use, Nuisance/Noxious/Offensive Conduct, Architectural Violations (failure to submit plans, failure to construct per approved plans), Parking & Vehicle-Related, Pet & Animal (Livestock), Rules & Regulations, and All Other Violations.
- Curable vs. uncurable violations: Uncurable violations (e.g., shooting fireworks, noise that is not ongoing, property damage, prohibited garage sales) incur a one-time fine and no cure period. Curable violations allow a reasonable period to fix before a fine.
- Enforcement process & notice: The board may send an optional courtesy notice, then a formal Notice of Violation by verified mail. Owners have 30 days to request a hearing. A hearing must be held within 30 days of request, with at least 10 days' notice. The association must provide a packet of documents 10 days before hearing.
- Exceptions to hearing rights: No hearing is required if the owner received a similar Notice of Violation within the prior 6 months, if the association seeks immediate injunctive relief or foreclosure, or if the violation occurred in a common area with immediate risk of harm.
- Legal action & liens: The board may refer violations to legal counsel for demand letters, injunctions, or suit. Attorney fees and costs become the owner's personal obligation. Fines may be levied as special assessments secured by a lien on the lot.
- What this document doesn't cover: This amendment does not include the full declaration, bylaws, use restrictions, architectural guidelines, or assessment collection procedures. It only updates the fining and enforcement policy.
