What Provence's governing documents say
Provence Townhome Addition is a townhome community in Corinth, TX, governed by a homeowners association (HOA). This document is an excerpt from the full Declaration of Covenants, Conditions and Restrictions (CC&Rs). It establishes the HOA, an architectural committee, and the power to levy assessments, but does not contain all community rules.
- Architectural review: No exterior improvements, construction, or alterations may be made without prior written approval of the Architectural Committee. Owners must submit plans and specifications; approval or deemed approval occurs within 30-45 days. The committee has broad discretion over aesthetics and harmony.
- Assessments & fines: The HOA may levy annual and special assessments against each lot to fund common area maintenance and operations. Unpaid assessments accrue interest and may become a lien on the lot. Fines may also be imposed for violations.
- Common areas & association duties: The HOA owns and maintains common areas (e.g., open space, fencing, sidewalks, recreational facilities). It must keep them in good repair and may acquire, insure, and manage common property.
- Enforcement & right of entry: The HOA may enter a lot (with notice or in an emergency) to enforce rules or perform maintenance, and may sue to enjoin violations. Costs of enforcement may be charged to the owner as a personal obligation or lien.
- Membership & voting: Each lot owner is automatically a member of the HOA with one vote per lot. During the Declarant Control Period, the developer holds weighted votes (100 votes per owned lot). After development, all board members are elected by owners.
- What this document doesn't cover: This excerpt does not include rules on pets, leasing, parking, trash, noise, or age restrictions. Those may appear in later sections or separate documents.
