Brookstone Estates is a single-family home HOA in the Dallas–Fort Worth area (Kennedale, Tarrant County). This is the full set of covenants, conditions, and restrictions (CC&Rs) that bind all current and future homeowners. It covers what you can build, how you use your property, and the HOA's powers and fees.
- Architectural review: Before any construction, exterior alteration, fence, wall, or landscaping/grading, you must get written approval from the Architectural Control Committee. The committee has broad discretion and can reject for insufficient information; if it doesn't act within 60 days, approval is deemed granted.
- Residential use only: All lots are for residential purposes only. No commercial or business activity open to the public is allowed. Trailers, mobile homes, motor homes, tents, shacks, and other non-approved structures cannot be used as residences, even temporarily.
- Nuisance & prohibited activities: No noxious or offensive activity that annoys the neighborhood is allowed; fireworks and firecrackers are prohibited. Oil, gas, or mineral drilling, mining, or quarrying is banned on any lot.
- Signs: Only one sign up to five square feet advertising the property for sale or rent is allowed on a lot. The developer may have additional signs during the construction/sale period.
- Parking & vehicles: No trucks, buses (except personal passenger vans), boats, or trailers may be parked on the street in front of a lot, or on the driveway/lot where visible from the street. Construction equipment is exempt during active building or repair.
- Assessments & fees: The HOA can levy regular and special assessments. The initial regular assessment is capped at $50 per month per lot, paid annually in advance (prorated at closing). The developer is exempt during the sale period. Assessments are a lien on the property, subordinate to first mortgages.
- HOA membership & voting: Every lot owner is automatically a member of the HOA. Each lot gets one vote; the developer holds 60 votes per lot until the sale period ends. After that, owners elect a 3-person board at an annual meeting.
- Duration & amendments: The covenants run with the land for 20 years from recording (April 2010), then auto-renew every 10 years. They can be terminated by a vote of more than 50% of owners; amendments require more than 67% of owners (after the sale period).
