What Capitol Avenue Townhomes's governing documents say
This document is an amendment to the Declaration for Capitol Avenue Townhomes, a Dallas townhome community governed by a homeowners association. It updates the rules for leasing townhomes, binding owners and tenants, and is only a partial update—not the full set of community rules.
- Minimum lease term: All leases must be for at least 30 days; no short-term or vacation rentals are allowed.
- Cap on leased homes: No more than 4 townhomes in the community may be leased at any one time, with possible exceptions for owner hardship (e.g., relocation, death of owner, temporary relocation, or lease to extended family).
- Lease approval and notice: Owners must give the board 30 days' notice before leasing and provide a fully executed lease copy within 10 days after signing. The board may require an owner hardship application and can limit approval to a set period (default one year).
- Tenant obligations: Tenants must comply with all governing documents, bylaws, and rules. Owners are responsible for tenant violations, including fines and damages. The association may evict tenants for noncompliance.
- Leaseback allowed: The leasing restrictions do not apply to leaseback arrangements when a townhome is sold and the seller leases back from the buyer.
