This is an amendment to the bylaws of the Hawthorne Court Homeowners Association, a townhome community in Dallas, TX. It updates voting rights, board meetings, director removal, fines, and other governance rules. It is a partial document—it only amends specific sections of the existing bylaws, not the full rulebook.
- Voting rights: Each townhome owner gets one vote per lot owned; if multiple people own a lot, they must decide among themselves how to cast the single vote. The previous two-class voting system (with extra votes for the developer) is eliminated.
- Board meetings & elections: The board must meet at least once per calendar year (previously quarterly), and can meet by phone or written consent. Annual meetings are required, with the first meeting no later than five years after the first townhome is conveyed or one year after 75% of lots are sold, whichever comes first.
- Board size & removal: The board will have three to five members. Directors can be removed with or without cause by a majority of owners at a special meeting, and replacements can be elected at that same meeting.
- Fines for rule violations: The board or managing agent may fine an owner up to $25 per occurrence for violating rules, bylaws, or the declaration. The association can also seek injunctions or legal remedies, but cannot use non-judicial summary abatement to alter or destroy property.
- Insurance & condemnation: The board must maintain insurance as required by the declaration. If part of the project is taken by condemnation, the association must use the proceeds to restore the remaining property to as close to its original condition as possible.
- Notices & mortgagee info: Owners must notify the association of any mortgage on their townhome. The board must report unpaid assessments or other defaults to the owner within 60 days. Notices to the association must be sent by certified mail to the then-president of the board.
