Shelby Intown is a single-family homeowners association (HOA) in Dallas, TX. These Bylaws govern how the association is run — board elections, meetings, voting, and enforcement — and apply to all lot owners in the subdivision. They do not contain the full set of use restrictions (like pets or rentals), which are in the Declaration of Covenants, Conditions, and Restrictions.
- Who runs the association: The association is governed by a Board of Directors of 3 to 7 members. The developer (Declarant) appoints the board until the 10th anniversary of the Declaration or until one-third of the lots are sold, after which owners elect directors. After the developer's control ends, at least two-thirds of directors must live in the subdivision.
- Owner voting & meetings: Owners may vote in person, by proxy, mail, or electronic ballot. A special meeting can be called by a petition signed by owners holding at least 20% of the total Class A votes. Proxies expire after 11 months. A quorum is required for official action.
- Board meetings & open records: After the development period, board meetings must be open to owners, with notice given at least 72 hours in advance (or mailed 10–60 days before). Certain actions — like fining, foreclosing, raising assessments, or adopting rules — can only be voted on in open meetings. Owners can inspect association books and records.
- Assessments & fees: The board sets annual and special assessments. Late payments accrue interest and can become a lien on the property. The board may charge fees for dishonored checks, partial payments, ownership transfers, refinancing, and providing resale certificates.
- Enforcement & fines: The board can impose reasonable fines for rule violations, which become a lien on the property, and can suspend an owner's right to use common areas. Owners must be given notice and an opportunity to be heard before fines are imposed.
