What Homeowners Association of Regency Place's governing documents say
This is a First Amendment to a Declaration of Restrictions and Grant of Easements for a commercial shopping center (Hebron Center) in Carrollton, TX. It governs use, construction, and parking among the owners of multiple parcels, not a residential community. The rules bind the commercial property owners and their tenants.
- Permitted uses and restrictions: Parcel 6 and Parcel 4 are excluded from the restriction; pre-existing leases allowing convenience store or petroleum sales remain in effect. Only Parcels 2 and 5 may have a convenience store or sell petroleum. H&R Block (max 2,927 sq ft), Lady of America health spa (max 4,505 sq ft), a dentist office (max 1,400 sq ft), and up to three restaurants (collectively max 7,033 sq ft) are allowed on Parcel 3 under specific distance and parking conditions. A donut shop (max 930 sq ft) is allowed on Parcel 1 under distance conditions.
- Fuel facilities: Fuel facilities (gas pumps, canopies, tanks, etc.) may be built and operated on Parcel 5, with building height limited to 23 feet and signs not exceeding 20 feet. Section 5.1 restrictions do not apply to Parcel 5. Fuel facility square footage is excluded from building area calculations.
- Easements: Parcel 3 grants a nonexclusive easement to Parcel 5 (via Parcel 2) for underground communications cables, lines, and conduits. Installation must be at least 3 feet below ground and not interfere with business operations; grantee bears all costs and must repair damage.
- Parking: Parcel 3 owner must maintain parking stalls behind buildings on Parcel 3 per the site plan. Employees of H&R Block and the dentist office must park only in designated areas on Parcel 3 during specified periods.
- What this document doesn't cover: This is only a first amendment to the original Declaration of Restrictions. The original declaration's rules on building area maximums, parking ratios, pro rata shares, and other general restrictions remain in effect but are not fully reproduced here. This document applies only to the commercial shopping center, not to residential uses.
