Montgomery Ridge is a single-family homeowners' association (HOA) in Allen, Texas. This document is a Covenant Enforcement and Fine Policy — an ancillary policy that details how the HOA enforces its rules and levies fines. It applies to all homeowners in the subdivision. For full community rules (e.g., architectural guidelines, use restrictions), you must also review the recorded Declaration of Covenants, Conditions and Restrictions.
- Fine amounts & schedule: For curable violations, fines start at $100 (initial), then $200, $300, and $400 for fourth and subsequent fines. Uncurable violations or those posing a health/safety threat can be fined up to $2,000. Unapproved ACC modifications: initial $200, then $300, $400, $500. Fines can be imposed daily while the violation continues, with no aggregate limit.
- Enforcement process & notices: The HOA first sends a Courtesy Notice (14 days to cure), then a Notice of Violation (specifying a cure date, and that fines/attorney fees may apply). If not cured, a Notice of Fine follows. Notices are sent by certified mail and first-class mail. Repeated violations within 6 months can result in doubled fines and reinstatement of previously waived fines.
- Right to a hearing: Homeowners can request a hearing before the Board within 30 days of the Notice of Violation. The Board must hold the hearing within 30 days of the request. The HOA must provide an evidence packet 10 days before the hearing. The homeowner may present their case, and an audio recording may be made. The Board's decision and sanctions are provided in writing within 10 days of the hearing.
- Common violations: Examples include: unapproved structures or modifications, holiday decorations left over 30 days, storage of boats/vehicles/trailers, trash cans visible on non-pickup days, unapproved signs, poor exterior maintenance (rotting wood, damaged garage doors), unkempt lawns, littering, inoperable vehicles, vehicle parking violations (each observation), unapproved roof, recreational equipment, pet waste/leash violations, livestock, and leasing/occupancy violations. This is not an exhaustive list.
- Corrective action (self-help): If a violation is not cured 14 days after a Notice of Violation, the HOA may have qualified contractors fix the issue after giving the owner a Notice of Corrective Action. All costs are charged to the owner's account. The HOA and its agents are not liable for damages if they acted reasonably and in accordance with this policy.
